
Terms of Service
These Terms of Service (“TOS”) are between you (“Customer,” “you,” and/or “your”) and Dragon Ventures, LLC, a limited liability company, DBA Southern Pool + Outdoors, its subsidiaries, affiliates, predecessors, successors, and assigns (“SPO,” “us,” “we,” and/or “our”). These TOS set forth the terms applicable to your use of our services (collectively, the “Services”). You and SPO together may be referred to herein as the “Parties,” and each may be referred to herein as a “Party.” These TOS explain our obligations to you, and your obligations to us in relation to any Services you purchase or otherwise utilize. These TOS apply to our provision of residential pool maintenance services only.
By signing up for our services, you acknowledge that you have read, understand, and agree to be bound by this TOS, as well as all other applicable rules or policies, terms and conditions, or service agreements that are or may be established by us from time to time and are incorporated herein by reference.

Our commitment to our customers – services provided:

As part of your routine weekly pool service, SPO will provide the following services including but not limited:

Checking and emptying skimmer and pump basket

Testing and balancing water chemistry
-
Supplying routine chemicals including chlorine (liquid and/or tablet), salt, muriatic acid, sodium bicarbonate, and cyanuric acid; specialty chemicals may be provided upon occasion such as phosphate treatments or algae treatments, at an additional cost.

Brushing your pool walls and floor, as needed.

Vacuuming your pool floor, as needed.

Skimming your pool surface, as needed.

Checking your equipment for normal function

Backwashing your filter (every month on average)

Cleaning your filter (every 6 months on average). Additional cost.

Cleaning your salt cell (chlorinator) if applicable (every year on average). Additional cost.

An emailed service report following each service with a detailed overview of services performed, chemicals used, and photos of your pool and spa, if applicable.

Customer responsibilities – our ask of you:

To efficiently and effectively provide proper service for your pool, we ask all customers to please:

Ensure our technicians have access to the pool area on the day of service: path to the pool needs to be clear of all clutter, as well as pet feces, allowing our technicians and their equipment to reach the pool; equipment area needs to be easily accessible and free of overgrown landscaping and pests.

All pets are secured for their safety and the safety of our technicians

Please make sure that swimming pool toys, floats, and non-automatic swimming pool covers are removed on the day of service

Please ensure the water level of your pool is maintained at the correct level – about halfway up the skimmer. Our technicians do not have adequate time allotted during weekly service visits to drain or re-fill the pool. If you require this service, please contact the office to arrange a separate service call.

Report any service issues or service requests to our office at 214-308-1744 so that we can ensure anything that pops up can be addressed in a timely manner, with appropriate oversight.

By providing your phone number, you agree to receive automated text messages from SPO for appointment notifications, reminders, and review requests. Message frequency may vary. Message and data rates may apply. Reply HELP for help or STOP to opt out at any time.

Billing information

All invoices are due no later than the 15th of each month – please plan accordingly to ensure bank checks are mailed and received in time. A $35 late fee may be applied to all payments received after the 15th day of the month.

Our monthly maintenance service rate is for a blue, clean pool with regular debris; should extra cleaning be required from weather events, an additional charge may apply.

We bill for 48 weeks of service per year, based on a standard 4-week-per-month cycle. Although there are 52 weeks in a calendar year, the extra 4 weeks are meant to allow for holidays, severe weather, or other unavoidable service interruptions. This ensures your rate stays consistent and predictable throughout the year. We allow our technicians time off the week of Thanksgiving and the week of Christmas and we do not service pools those two weeks. We work all other holidays.

Minor repairs / replacement items of $95 or less will be automatically billed to customers (o-rings, pump baskets, skimmer baskets, cleaner parts, pressure gauges, air release valves, etc.). In addition, if damaged filter grids, cartridges, or filter manifolds are discovered during a filter clean, we will replace those essential items at that time and the items will be on your next regular monthly invoice.

Should SPO be required to take legal action to collect payment with liens or small claims court, all fees associated with the collection process plus and administrative fee of $95 will be assessed to the customer’s account balance

SPO will attempt to run cards on file for overdue invoices that are not set to autopay before moving forward with any collection procedures.

Credit card and ACH surcharges will be passed back to customers to account for the charge we pay to accept credit card and ACH payments.

Additional information
-
While we will try to diagnose any potential equipment issues or concerns during our regular weekly service visit, a trained repair technician may be required to diagnose and trouble shoot potential equipment issues. Please note, this visit would be a separate service call and be billed accordingly.

While we strive to ensure continuity in service technicians servicing your pool week over week, as we grow and expand our business, as team members get promoted, or take time off, it may be necessary to change your assigned service technician from time to time. We understand that continuity is important to our customers and we strive to ensure continuity for you.

Service days may occasionally change due to routing and scheduling adjustments. While we aim to maintain the initially provided service day, we cannot guarantee that it will never change.

We aim to provide full service each week. However, sometimes due to environmental conditions such as lightning storms, heavy rains, high winds, or other acts of nature, providing full service on your designated service day may not always be possible. However, we will still check and adjust the chemicals and empty the baskets, regardless of the weather conditions

Cancellation

We do not hold our customers to long-term contracts and believe open communication is key to a successful partnership.

If for any reason you need to cancel service, we are happy to accommodate. All cancellation requests should be made in writing and directed to the office via email at Hello@SouthernPoolandOutdoors.com.

Partial month service will be billed at our one-time service call rate of $95 per visit.
